Oklahoma Puts Voter ID in Its Constitution & a Judge Blocks Ohio 39 Days Out | Washington, McNeily

Episode Summary

Voter identification went two different directions in the same week, in two states 900 miles apart. In Oklahoma, voters themselves wrote photo identification into the state constitution, which means no future legislature can take it back with a simple majority. In Ohio, a federal judge appointed by President Bill Clinton blocked the state from requiring proof of citizenship at motor vehicle offices, 39 days before Ohio's voter registration deadline. Jenny Beth Martin works through both with co-host Robert McNeely, and then tells the origin story almost nobody has heard: the SAVE America Act, the Safeguard American Voter Eligibility Act, began with a coalition conference call with Senator Mike Lee, and with Arizona. Arizona passed a statewide referendum requiring proof of citizenship to register, lost at the Supreme Court, and ended up with a bifurcated ballot, where a voter who has not shown proof of citizenship still votes for president, Senate and Congress. That loophole in the National Voter Registration Act is the entire reason the bill exists. The Supreme Court also let President Trump's mail-in voting order take effect on a six to three ruling on August 24, and 23 states and the District of Columbia sued again two days later.
